The Fraud of the Century

Bernard Madoff was a creditable man that people trusted him with their money because â€Å"he created an image of power, trust and responsibility. † (Ferrel, 2013, p. 416) He was able to scam and scheme his investors from the early 1990s up until December of 2008 when his Ponszi scheme was discovered. Over the course of a decade he was simultaneously running a legitimate business and earned his investors’ trust because he didn’t make any promises of unbelievable returns. He was a financial expert, served as chair on NASDAQ, and a seat on the government advisor board on stock market regulations.These titles have added to his creditability and people didn’t question him when they hand over their money. He wasn’t able to continue with his scheme and cover it up once the economy started collapsing in the late 2008. This was when his scheme was starting to expose because he wasn’t able to pay back his clients when they requested for their money ba ck. March of 2009 he plead guilty to the charges and later in June 2009 he was sentenced to 150 years in prison. It’s amazing how he was able to pull the fraud of for so long without anybody questioning his strategy.As early as 1992, federal regulators were investigating Madoff and the investigation was dismissed because there was no improper trading practices found. In fact from 1992-2005, his business was continuously being interviewed and investigated, but no wrongdoing was found. In 2006, his business was registered with SEC and that’s when they found misleading behaviors and in 2008 there was an alert stating all his records maybe pointed to possible corruption. Even with the 2008 alert, the allegations were dismissed and no further investigations would happen.Finally in 2009, SEC received enough evidence to convict him of his fraud because two of Madoff’s investors filed a lawsuit against the SEC. The way he conducted business was unethical because not onl y did he mislead his clients but also he misled his friends and family. He was able to gain their trust and con his way through a long prosperous deceiving investment. People were guided and yet blind sighted by his character. Another unethical business transaction was using money from an illegal business to cover up the losses for his legal one.Not only that when he needed quick cash to try and save his scheme in 2008, he solicited and even  threatened some of his clients for more money to invest. This is an ethical issue because the clients felt guilty for not being a better client and investing more into this â€Å" privilege† and exclusive† investment opportunity. I think that Bernard Madoff was not operating alone. I think his family was somewhat suspicious and went along with the operation but did not know entirely what was going on. I think with their experience and knowledge, they should have questioned when Madoff chose to hire inexperienced and uneducated pe ople to work for his investment management business.I think they chose to ignore the situation because of his high and respectable reputation. Also because he was family and they felt that he wouldn’t harm them. I think that in order to avoid this type of Ponzi scheme, an audit should be done every year along with any transaction of high value. Some type of documents and records of investments should be easily assessable for investors to follow and understand. Clients should be able to view their portfolio at any given time.

Cosmic Race Essay

The term â€Å"Cosmic Race† is also known as â€Å"La raza cosmica† which was based on the opinions of some Mexican Scholars in the 1920’s who held that since the Latin Americans held the blood of all the races, the transcended the races of the â€Å"Old World†. This term basically embodies the idea that traditional, exclusive concepts of race and nationality can be transcended in the name of humanity’s common destiny (MacLachlan, 1980). While the idea of the origins or creation of the â€Å"Cosmic Race† has been attributed to other races, there is no denying that it was the Spaniards who played a major role in this. The open-mindedness, in this case the open philosophy and attitude of Spain regarding culture and society, was influential in creating this cosmic race. Spain realized that the key to being able to build a vital and flourishing economy in the colony was to build a common denominator for acculturation by both Indian and European races (MacLachlan, 1980). Spain was able to accomplish this by establishing and expanding the colonial political and ecclesiastical institutions, the economy, society, and the role of women in the Mexica Society. Further proof of this was the policies of Spain regarding women as they encouraged the women to participate in economics and politics by providing the women during that time with extensive legal rights (MacLachlan, 1980). But it wasn't until the late fifteen hundreds that there are records of candles being used in theatres in Italy. Their popularity spread over Europe and to England by the early sixteen hundreds. Candles became the most significant light source for theatre productions. In the beginning candlelight was used to illuminate the members of the audience as well as the production and its actors. Candles were usually set in chandeliers over the audience and the audience section was under constant illumination during the performance while the stage would have varying degrees of light. Stagehands would snuff out and light candles according to the stage directions and there were also mechanical contrivances, different full chandeliers and partial branches were also used: Some of the branches could b e lowered by wires and pulleys so that the candles could be lit, snuffed, and extinguished. The SEC (2013) also states â€Å"the result of this information flow is a far more active, efficient, and transparent capital market that facilitates the capital formation so important to our nations economy† (para. 7). The SEC is proactively working with other major markets that participate in environmental securities to certify that this guideline is being followed. One of the SEC functions is to supervise the participants in the area of securities world. The securities would include the areas of securities exchanges, securities brokers and dealers, mutual funds as well as investment advisors. Another function the SEC provides is the promotion of disclosure of market related information and to maintain appropriate dealings. When Congress passed the Sarbanes-Oley Act, it was â€Å"to provide greater protections to investors, creditors, and other stakeholders† (University of Phoenix, 2014, p. 3). SOX will provide greater protection by â€Å"reducing unethical corporate behavior† (University of Phoenix, 2014, p. 3). The SOX play a major function with the SEC because not only this also helps protect the public from fraud a corporation can commit, but because this can provide solutions to issues, the SE C is confronted with based on fraudulent accounting practices. A scandal and major concerns on how American Corporations are governed was the Enron and WorldCom scandal of a series of massive corporation frauds. As a result, the Public Company Accounting Reform and Investor Protection Act of 2002 were developed. The Sarbanes – Oxley Act has played an important role in the regulatory environment which will protect the public from fraud within corporations. The Marketing Of Haier In Europe Abstract In todays business world filled with kinds of opportunities, competitions and challenges, marketing is playing a more and more important role. Correspondingly, marketing strategy and marketing mix are also more and more crucial for a company to enter a certain market and to sell products, no matter it is a domestic or transnational one; meantime, they are also beneficial to take market share if used effectively. The Haier Group, with Haier Europe is a classic example that makes full use of the marketing strategy and marketing mix to achieve its marketing goals. The focus of this dissertation lay in the exploration of the marketing strategy and marketing mix of Haier Europe, of solutions to its current difficulties in launching their product portfolios there and of the implementation of its tactics in Europe. Section One Introduction As a professional tool used to analyze the market, understand customers, and present a product or a service to the potential benefits of customers thus persuading them to accept and buy it (Steinberg, 2005, p1), marketing is by no means common. In the right hands, it can be unlimited-powerful. This dissertation purposed to explore the marketing strategy and marketing mix of Haier Europe. On the base of datas collected, Haier is still struggling with many difficulties in launching their product portfolios there. In addition, it has entered the crucial strategic periodGlobal Branding. How to cope with current problems and to establish its tactics in Europe? The dissertation also aims to seek appropriate solutions to this pending issue. In terms, Haier, as a famous Chinese company incorporating in 1984 and a domestic who dare to go abroad, Haier performs remarkably in the respect of marketing. Since the 1990s, it has differentiated into related white, black and beige goods (Bell, 2008, p157). As Chinas ambassador to appliance stores worldwide, now Haier is the worlds 2nd largest white goods manufacturer making appliances under more than 90 product categories. Today, Haier is exporting its goods and selling them in more than 160 countries and regions such as North America, Europe and the Middle East etc.. After its first entering through Germany, now Haier is well-known in Europe, including United Kingdom, Ireland, Germany, Netherlands, Belgium, France, Luxembourg, Greece, Spain, Portugal, Switzerland, Austria, Italy, Denmark, Norway, Finland and Sweden, where it obtained revenues of US ¼Ã¢â‚¬Å¾136m. In Europe, Haier target at the high-end market, and carried out its trilogyseeding, rooting and harvesting to create the localization of Haier brand (CRI online, 2004). The products Haier sells in Europe are refrigerators, freezers, top-load washing machines, home air conditioners, water heaters, microwave ovens, dishwashers, television sets, computers and cell phones (Haier Official Website, 2010). Even more important, having advanced through the Brand Building, Diversification and Internationalization stages, Haier has embarked on its fourth stageGlobal Branding. It makes meaningful sense to study its marketing strategy. This paper encompasses three sections with section II consisting of three sub-sections. In this paper, after some theories about marketing explained firstly, the current situation of European retail electrical equipment market will be identified, followed by a analysis about both the internal and external environmental factors facing Haier; then it will demonstrate the marketing strategy and marketing mix of Haier Europe; finally, from the perspective of a real-world business, some rational recommendations for Haier Europe will also be made. Section Two Literature Review Baker et al(1998) concluded that marketing is both a concept and a practice having important implications for the adoption and implementation of market thinking, and also an approach to exchange relations which drives and informs the strategies of every organization. Here some marketing theories, including the PEST, the Porters Five, the SWOT, the ANSOFF and Marketing Mix should provide a sound conceptual basis. There would be a lot of unexpected risks and challenges if it is carried out without a full understanding of the market. So firstly, comprehensive insights into the present condition, even the medium-to-long developing trends of an industry, say three to ten years ahead, is needed. To review and exploit the broader environment, it can draw support form a PEST analysis and the Five-Force Model. PEST typically refer to by its acronym, for the types of elements it involves: political, economic, sociocultural and technological, all of which are likely to have large or small effects on the organizations ability to achieve competitive advantages at some stage over the next few years (Sargeant and Jay, 2004, p175). However, the PEST analysis should be combined with the Five-Force Model, which analyses t he structure of an industry or market segment, from the viewpoint of its attractiveness to a player already in the industry (Faulkner and Bowman, 1995, p37). SWOT is a planning exercise in which managers recognize a organizations strengths(S), weaknesses(W), opportunities(O) and threats(T) to select the corporate-, business-, functional-level strategies to best position the organization (Jones and George, 2004, p151). Strengths are skills and capabilities that enable, while weaknesses hinder an organization to conceive of or implement its strengths, yet both of which it has some control over; opportunities are areas that may generate higher performance, while threats increase difficulties, and both of them are beyond the organizations control (Griffin, 2007, p67-68). Then Ansoff Matrix, a version in which strategies are often shown, is used to formulate basic product and market growth strategies,. Ansoff defines two key factors for marketingwhat is being sold and what it is sold to (Stone, 2001, p50-51). A firm can vary its marketing mix by changing one or more of elements, for example, it may use one marketing mix to reach a particular target market and different mix to reach another, anyway, the most principle is to keep a balance across and betw een all marketing mix elements. Section Three Analysis and Discussion 3.1 Haier and European Retail Electrical Equipment Market Unlike in the US, where Haier America is in charge of all functions and sells full products portfolio under one roof. In Europe, Haier had established a bunch of different sales offices: Haier Europe Trading, based in Italy, sell Haier white goods into Europe; Haier Electronic Europe is responsible for Haier audio-video and mobile phones; Haier A/C Europe trade Haier air conditioners through separate subsidiaries located in Spain, Italy and UK (Bell, 2008, p183). Undoubtedly, this makes Haier Europes operations relatively dispersed, which scattered consumerss holistic and unified impression on it. There have been more and more people, who are not necessarily deep green willing to allow this to influence their decision-making when buying an appliance, especially Europeans who has perceived the environmental protection as a public issue long ago and made environmental protections roots in varied areas (Wenk, 2005, p9-10), they look more favorably on green home appliances. This also urged Haier Europe to be green to meet their green demand, which become a selling point in the European market. Last but not the least, the impact of technology to home appliance industry is tremendous. Adopting new technologies or automaton for improving productivity and cost effectiveness is regarded as opportunities (Kumar, 2006, p38-39). Among its various products, Haiers refrigerators and washing machines are world-class. In Europe, where quality and feature are top priorities among consumers, Haier is committed to manufacturing specific products and its tag line is Haier and Higher (McNally, 2007, p90). Haier strictly pay attention to manufacturing skills, technical progress and product quality all the time. à ¢- Service Strength Haier sets the benchmark of from in-store services to after-sales service. It is known that uniformed personnel of Haier offering on-site service will show up in less than 24 hours after a customer require services, with all necessary tools including a pair of socks not to dirty the ground of customers (Hexter et al, 2007, p137). It is Haiers intimate service that contribute to its success, which is also one of its core competitiveness. Haier has always adhere to the creed of users first and believes that brand is created, promoted, maintained and developed by high-quality service. à ¢- Channel Strength Haier was acknowledged to have the best and the most strict distribution system and sales force (Williamson, 2004, p47). Haier adopt personalized marketing according to the characteristics of different consumers. According to different channels, Haier Europe work out targeted policies and provide different support. However, Haier also has been fully aware of its weakness from early days, which can be analyzed with the Porters Five. à ¢- Competitive rivalry amongst existing firms Porter(1980) listed the the slow growth of or declining demand will create further intensification of competitiveness. Moreover, even though Haier Europes products are manufactured and sold in local market, most of their design work is still done in China, which may also affect the Europeans perceptions of Haiers products to a certain extent (Temporal, 2006, p89). à ¢- The bargaining power of suppliers Suppliers of Haier are those who provide inputs such as capital, material, special manpower, services and so on. Now Haier still remain highly dependent on foreign key components and technologies, such as high-performance electronic-motors, compressors, controllers and so on (Bell, 2008, p171). Then next options to be considered are to supply a new product to the current market, or to market the present product to a new market (Faulkner and Bowman, 1995, p80). Of course, the risk to bear will also ascend to a certain extent. In general, the above three options are most common and relatively insurance for Haier Europe. Only in few exceptional contexts should the option to market an unfamiliar product to an unfamiliar market be thought over. To root even to further consolidate and develop, on the one hand, Haier Europe sold more or increased share of its products; on the other hand, i t vigorously push the internationalization of its product design forward in Europe. Besides, whenever it is up-swing of a business cycle or recession, Haier has always focused on its core product, around which it form the products cluster; and according to the consumption power of consumers and their demands about the function, the costs etc. to modify its products. Even though having developed diversified products and began to regulate its industrial chain, Haier Europes focal product is always the refrigerator. Introduction Why Use OPNET Modeler Computer Science Essay OPNET Modeler is a very good tool for network designing and simulation. OPNET Modeler was selected because most of the wired and wireless network components are available in the OPNET 15.0 Modeler. In this version a number of different models can be created to simulate, analyze and compare their results. This chapter explains how the different wired and wireless network has been designed and simulated in OPNET Modeler. In this project different scenario for Ethernet, DSL, Wi-Fi, and WiMAX in two different projects has been created in OPNET Modeler 15.0 . There is also a comparison between the wired and wireless networks. The Ethernet network is compared with the Wi-Fi network and the DSL network is compared with the WiMAX network. Overview of OPNET Modeler OPNET stands for Optimized Network Engineering Tool. The OPNET Modeler is a very powerful tool for the network modeling and simulation. The purpose of the OPNET Modeler is to optimize cost, efficiency, performance, viability and scalability characteristics of the network. In addition OPNET Modeler has a huge library of nodes(fixed, mobile or satellite), links(simplex, duplex, wired or wireless), and subnets, which are used to design and simulate network configuration, protocols, traffic and end user applications. OPNET Modeler has three hierarchical levels or editors. These are Project Editor Project editor is also known as network editor. The project editor is the key staging area for modeling a network simulation. In the project editor a network can be created by using the nodes, link, and subnets from the standard library, then select statistics, run the simulation and view the results of the network. FIGURE: Node Editor To built models of nodes the node editor is used. Node editor specifies the internal structure of the network node. The node includes workstations, satellite terminals, switches, and remote sensors. The OPNET node has a modular structure. The packets and status information are exchanged between modules which are connected via packet streams or statistic wires. Every module performs specific function, such as generating packets, processing packets, transmitting and receiving packets or queuing packets. FIGURE Process Editor The process editor is used to design process models, which controls the basic functionality of node models generated in the node editor. The process models are represented by Finite State Machines (FSMs). The FSMs are generated with icons, which show states and lines which shows transitions between states. The process models are expressed in C or C++ language. Figure In this chapter four different scenarios are discussed. These are Scenario1: Ethernet Network Model In this scenario a new wired network for Ethernet is created in OPNET Modeler as shown in figure. This scenario is created for campus network. In this scenario seven workstations are connected to the switch. With the help of a router the switch is connected to the server. The switch is connected to the router which is connected to the server. Ethernet links are used to connect all these nodes with each other. The server provides different applications used for the workstations. For this network model we also need to define the applications and profiles by adding a node for the application and profile. The workstations are associated with the profiles in order to use different applications. By default the application configuration has a maximum of sixteen services, which are supported by the OPNET Modeler. These are http, ftp, e-mail, print etc. In this scenario the default services are selected as shown in the figure To configure the application node right click on it, select Edit Attributes a dialogue box will open. Change the name field value to application. Expand the Application Definitions row, select the default option while left other setting at default as shown in the figure. For this scenario one profile is defined namely shahid. The profile node can be configured by expanding the profile configuration row. Define the profile namely shahid also define the applications and change the operation mode to simultaneous while left the other setting at default as shown in figure To configure the profile configuration right click on it, select Edit Attributes a dialogue box will appear. Change the name field value to profiles. Expand the profile configuration row, select edit. In the server configuration, three applications supported services were defined namely http, ftp, and e-mail while all other settings are left at default as shown in figure. The workstation can be configured by selecting the Application Supported Profiles namely shahid while left all the other parameters at default as shown in the figure. Both are forwarding the traffic to the end nodes. The router and switch are connected to each other through Ethernet link. Scenario2: WLAN Network Model In scenario 2 a wireless network model for WLAN is created in OPNET Modeler as shown in figure. This scenario is also created for the campus network. This scenario is similar to scenario1 with slight changes. In scenario2 the switch of scenario 1 is replaced with the wireless access point (AP) and also the workstations are replaced with the wireless LAN workstations. The main function of the wireless access point is to transmit and receive the wireless signals. The access point is connected to the router which is then connected to the server through Ethernet link as shown in figure. The configuration of the wireless access point (AP) and the wireless workstations are as follow. Wireless access point (AP) configuration The wireless access point (AP) transmits and receives the wireless signals. The wireless access point can be configured by expanding the wireless LAN parameters. The access point functionality should be enabled so that this node can transmit the wireless signals. The BSS Identifier value is set to 0. If there is another wireless access point (AP) in the network then its BSS Identifier value must be different. The other setting is left at default as shown in figure. But in this scenario the BSS identifier value for the workstations is also defined. The BSS Identifier value is set to 0. This value must be the same as the wireless access point BSS Identifier value. The access point functionality is disabled for the workstations. The remaining settings are left at default as shown in figure. In this scenario four workstations are connected to the switch through the Ethernet links. The switch is connected to DSL modem. The DSL modem is connected to the DSLAM via the DSL links. The type of DSL used for this scenario is Asymmetric DSL (ADSL). The ADSL has a high downstream data rate than the upstream data rate. The function of the DSLAM is to linked several users to the high speed backbone network. The DSL modem is used to send and receive signals. The DSL modem has internal signal splitter that carries voice signal on the low frequencies and carries data signal above that frequencies. With the help of IP cloud the DSLAM is connected to the server via the PPP link. The figure shows the DSL network model. This scenario is the same to scenario3 but there is a slight changes. A new node is added for the WiMAX configuration. Without this node the WiMAX network will not work. In this scenario the DSL modem is replaced with the WiMAX basestation, the switch is replaced with the subscriber station and the workstations are replaced with the wireless workstations. The WiMAX basestation will transmits the wireless signal over a long distance. The subscriber station which is found at the costumer site receives this signal, which is then sent to the wireless workstations. The subscriber station and the WiMAX basestation communicate through air interface-. The WiMAX basestation is communicating to the server through the ip cloud and router via PPP link. Pompey who had promised his veterans land. The way he disbanded his army and approached the Senate alone requesting his reasonable requests seems to suggest that he was fairly confident that he had achieved enough, and that the Senate would pass the request, but instead the Senate rejected his requests. A few attempts where made to pass the land bill for his troops with the use of Afranius and Metellus Celer both proved ineffective. His political career had too stagnated and hit the wall, this would be going nowhere. The senate rejecting the ratification of the eastern settlement, which is perfectly normal due to the fact that sources suggest that Pompey did it on his own, will and did not consult the senate, so the even though what he did was an extraordinary achievement the Senate can say no and so they did. Caesar upon arriving back from his outstanding success, in Spain he paid back his enormous debt to Crassus and still a multi millionare. On his return he wanted a triumph and the consulship, but since he could not as a commander enter the city to stand for election, he asked the Senate for permission to stand in absentia. "Though there were precedents, the Senate refused." Caesar abandoned his triumph and entered Rome as an ordinary candidate.

Fall of Constantinople By 350 A.D., Constantinople was one of the world's greatest capitals. The city was located between Asia and Europe, making it a very diverse and strategic place. The many bodies of water surrounding the peninsula gave Constantinople many trade routes as well as protection. The famous walls were also built to further strengthen security. Constantinople eventually rose to a beautiful city of strength and wealth. Its Greek heritage separated itself from the West with their religion of Eastern Orthodoxy. Despite the power of Constantinople, unending attacks and problems would eventually weaken the city. The first major catastrophe took place in 542, when a plague struck and killed massive amounts of people. The recovery was very slow, and it allowed for countless attacks. For Constantinople, however, it was just the beginning. Justinian ruled the Byzantine Empire during its height. His military faced strength from the East that greatly endangered his people. The Sassanian Empire of Persia was one threat that Byzantines needed to conquer. The Persians endangered eastern lands, so Justinian's military prevented any conquest. The Sassanians were defeated and security was briefly gained. After his success, Justinian wanted to regain lands the Roman Empire once lost to invaders. Byzantine armies began a reconquest of Spain, Italy, and North Africa. Battles against various Germanic groups took place, and western lands were conquered by the Byzantines. The wars were expensive, and resources were low. Defense became weak and territories were lost increasingly after Justinian's death. During the early 700s, the Byzantine Empire was in turmoil and chaos. As Leo III took power, Constantinople was being attacked by Avars, Bulgarians, and Arabs. The Arabs from the Middle East were a main concern for Leo III because of their large conquests in the Asia Minor. The Arabs advanced to spread their faith of Islam and control resources. The Arabs slowly acquired land until their siege on Constantinople itself. Leo III made brilliant defense moves to stop the invaders. His military forces attacked the Arabs from the rear successfully while naval forces were repelled with Greek Fire. Greek Fire was the empire's secret weapon that may have saved them from the Arab siege. Arab ships would burst into flames from contact with the "liquid fire." Fighting continued for a year until the Arabs retreated. Constantinople was defended successfully, but the empire suffered heavy losses and continued to loose land. The era from about 1025 to 1453 witnessed the Byzantine Empire in its ultimate destruction.

This story also portrays the pessimism felt by the people at this time. At this time in history, the world had just suffered the worst war in the history of man-kind up to that date. Also, the United States had not that long ago gone through the Civil War to free men from the oppression of slavery. However, some felt that the freedom the slaves were given had led to more oppression in the northern, industrial states that paid poorly for the jobs they held, in effect a new form of slavery. This era was the age of war. Not only was it an era of war, but also a time of great extremes. There were the very rich and wealthy people, and there were the very poor and poverty-stricken people, a middle class had not really been established at this point in time. The poor had little to hope for and their plight in life was beyond their control. A dream world was a way for them to escape the sorrows of their lives, perhaps the only way for many. Soon to come would be the bigges t war in the history of man, World War II.

Dear teens, here’s how to balance your social life and school! Steps Do your homework as soon as you get home. It’s tough, and you want to relax. But this is a great strategy to use; if you do your homework the second you get home, you have the rest of the night to relax. Do this even on Friday. Make it a habit. Listen to music while doing homework. This helps you work at a faster speed and seems to make time go by quickly. However, not everyone can work while listening to music, so if you happen to be one of these people, then you can work in an environment without music – it’s perfectly fine. Turn off your cellphone and television while doing your homework. Distractions are the number one reason why you take five hours instead of one to complete your homework. Have a lot of homework? Then maybe do some on the bus ride home. This won’t work if you walk home from school, though. What you can do is try not to burn the midnight oil or do your homework at the eleventh hour. During lunch break, try to do at least some homework given to you earlier in the day. Don’t ever be afraid of being made fun of. If you really have no time to complete your homework, try explaining it to your teacher. She or he will understand, because teachers used to be students, and after all, they’ve gone through what you’re going through now, right? If your teacher announces there’s going to be a test the following week on Friday, don’t study for it on Thursday. Slowly take your time to study a few chapters a day in the afternoon so that you have lots of free time to socialize after that. Now you’re free to hang out with your friends. I know you’re thinking, â€Å"None of these steps will work! † Well, you’ll never know unless you try. After all, if hanging out with your friends is really that important to you, you would take any option you have.
